Terms of Service

By creating an account, subscribing to a plan, or otherwise accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use our services. We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and, where practicable, by sending notice to the email address associated with your account at least 14 days before the changes take effect.

OpenClaw Akamai Hosting provides managed hosting for the open-source OpenClaw AI assistant on Akamai Connected Cloud infrastructure. Our services include server provisioning, initial configuration, automated backups, monitoring, and ongoing infrastructure maintenance.

We provide the hosting infrastructure and management layer. The OpenClaw software itself is open-source and maintained by its community. We do not guarantee the functionality, accuracy, or availability of any third-party AI model providers, messaging platform APIs, or other external services you may connect to your instance.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice to active subscribers. We will provide at least 30 days' notice before discontinuing core hosting services to allow you to migrate your data.

To use our services, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at hello@openclawakamai.com if you suspect any unauthorized access to your account.

You must be at least 18 years of age to create an account and use our services. By registering, you represent and warrant that you meet this age requirement and that all information you provide is truthful and accurate.

You agree to use our services only for lawful purposes and in accordance with these Terms. You retain full administrative control over your dedicated server and are solely responsible for all content, data, and activities on your instance.

You agree not to use our services to: distribute malware, spam, or other harmful software; conduct denial-of-service attacks or other network abuse; host or distribute content that violates applicable law, including but not limited to content that infringes intellectual property rights or facilitates illegal activity; attempt to gain unauthorized access to other users' systems or our internal infrastructure; or resell, sublicense, or redistribute our services without a Partner-tier subscription or prior written consent.

We reserve the right to suspend or terminate your account if we reasonably determine that your use of our services violates these Terms or poses a risk to our infrastructure, other users, or third parties. Where possible, we will provide notice and an opportunity to remedy the violation before taking action.

Our services are offered on a subscription basis with monthly or annual billing cycles, as described on our pricing page. All fees are quoted in US dollars and are exclusive of applicable taxes unless otherwise stated. You are responsible for paying all taxes associated with your use of our services.

Subscription fees are billed in advance at the beginning of each billing cycle. Annual subscriptions are billed as a single payment at the start of the 12-month period. You authorize us to charge the payment method on file for all recurring fees until you cancel your subscription.

If payment fails, we will attempt to process the charge again and notify you by email. If payment remains unsuccessful after 14 days, we may suspend your services. Your server data will be preserved for an additional 14-day grace period, after which your instance may be decommissioned. We encourage you to maintain up-to-date payment information to avoid service interruptions.

The OpenClaw Akamai Hosting website, branding, documentation, and proprietary management tools are owned by us and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of our proprietary materials without our prior written consent.

The OpenClaw software is open-source and licensed under its own terms. Your use of OpenClaw is governed by the applicable open-source license, and nothing in these Terms restricts or modifies the rights granted to you under that license.

You retain all ownership rights to the data, content, and configurations you create or store on your OpenClaw instance. We claim no intellectual property rights over your instance data. You grant us only the limited permissions necessary to provide the hosting services you have subscribed to, such as running automated backups and monitoring server health.

To the maximum extent permitted by applicable law, in no event shall OpenClaw Akamai Hosting, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of or inability to use our services.

Our total cumulative liability for all claims arising out of or related to these Terms or your use of our services shall not exceed the total amount you paid to us during the 12-month period immediately preceding the event giving rise to the claim.

Our services are provided on an “as is” and “as available” basis. While we strive to maintain high availability and performance, we do not warrant that our services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

You may cancel your subscription and terminate your account at any time through your account dashboard or by contacting us at hello@openclawakamai.com. Upon cancellation, your service will remain active until the end of your current billing period. We do not offer prorated refunds for partial billing periods unless otherwise required by applicable law.

We may terminate or suspend your account immediately, without prior notice, if you materially breach these Terms, engage in fraudulent or illegal activity, or if we are required to do so by law. In the event of termination for cause, you will not be entitled to a refund of any prepaid fees.

Upon termination, we will preserve your server data for 14 days to allow you to retrieve your information. After this period, your dedicated server and all data on it will be permanently decommissioned. Sections of these Terms that by their nature should survive termination will remain in effect, including but not limited to intellectual property, limitation of liability, and governing law.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the federal or state courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
